This resource was prepared by Wotton Kearney in partnership with Digital Rights Watch as a practical tool for community legal centres, civil society and not-for-profit organisations to engage with the Australian Government’s consultation on the Online Safety Amendment (Digital Duty of Care) Bill 2026 exposure draft (the Bill) which is available here.

The consultation on the Bill closes at 12pm on 22 September 2026. Submissions should be sent to the Department of Infrastructure, Transport, Regional Development, Communications, Sport and the Arts at digitaldutyofcare@communications.gov.au. See Part 4 of this resource for a template submission.

We have done our best in the short time-frame since the release of the exposure draft to provide enough background information, context and analysis for your organisation to form its own positions, picking the key issues that are most relevant to your work. Our aim is to support you to write a submission in your organisation’s voice, drawing on your expertise and clients’ lived experience.
